Rule 26
Hearing Procedures
(1) When the following positions are vacant and recommended for appointment, the names of potential candidates for the vacant positions should be proposed and sent to the committee for parliamentary hearing by the relevant body: (a) Chief Justice and Supreme Court Judge of Nepal, (b) Heads and officials of constitutional bodies, (c) Members of the Council of Justice, and (d) Ambassadors. However, before any position requiring a parliamentary hearing becomes vacant due to any matter mentioned in this rule, the process of appointment shall be initiated and the name of the candidate proposed for appointment to the said position shall be proposed and sent to the committee by the relevant body for parliamentary hearing. (2) The committee shall hear the list received according to sub-rule (1) within forty-five days from the date of receipt of the letter from the concerned body and prepare the opinion of the committee for the proposed position and send it to the concerned body. If the committee fails to provide its decision to the relevant body within that time, there will be no obstacle for the appointment to the position sent for hearing. (3) If the proposed name is not rejected in the opinion received from the committee according to sub-rule (2), then the relevant body shall appoint him to the proposed position and send such information to the committee. (4) The meeting of the committee will be called by the chairman as per the need. In order to hold a meeting of the committee, the presence of one percent of the total number of members of the committee shall be mandatory. (5) The name obtained according to sub-rule (1) shall be deemed approved if it is not rejected by a majority of two-thirds of the total number of members of the committee. If rejected, the committee shall provide the committee's actions regarding the name received for hearing, the documents received by the committee and other details to the relevant body as soon as possible. (6) Other procedures of the committee shall be as determined by the committee itself.
